1. About The Mise
The Mise is an operations platform for hospitality venues — a recipe and prep book, food safety compliance records, and a guest-facing allergen and dietary page — provided by The Mise, based in Byron Bay, New South Wales ("we", "us", "The Mise"). It is a record-keeping and organisational tool. It does not itself guarantee that a venue meets its obligations under food safety law, and using it does not transfer that responsibility away from the venue.
2. Access
Access to a venue's book is by staff code (read) or chef passcode (read and write), issued by the venue, not by open sign-up. Whoever holds a code is responsible for keeping it secure and for anything recorded using it. A venue is responsible for who it gives its codes to and for revoking a code (by changing it) when someone leaves.
3. One build, one venue at a time
Each venue's book, compliance records and dietary page are separate from every other venue's, addressed by that venue's own URL. A code issued for one venue does not open another venue's records.
4. Acceptable use
The Mise may not be used to: enter records you know to be false; share a staff or chef code with anyone outside the venue's own team; attempt to access another venue's data; interfere with or disrupt the service; or reverse-engineer, resell, sublicense or white-label the platform without our written agreement.
5. Availability
We aim to keep The Mise available and responsive, including offline access on a device that has previously signed in, but we don't guarantee uninterrupted access. Maintenance, updates or issues outside our control may affect availability from time to time. Features may be added, changed or retired as the product develops.
6. Your venue's content
Recipes, records, photos and any other content a venue enters remain that venue's own. We claim no ownership over it. We don't use one venue's content to train, market to, or benefit another venue without permission.
7. No current billing
As at the date above, The Mise is not sold on a public subscription — there is no self-service sign-up, pricing or payment flow. Any commercial arrangement for a venue's use of The Mise is agreed separately and directly, and these Terms sit alongside that agreement, not in place of it. If and when a public subscription is introduced, these Terms will be updated to reflect it before it launches.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, for any regulatory action or penalty arising from a venue's own compliance failures, or for data loss arising from circumstances outside our reasonable control. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy available under the Australian Consumer Law that cannot lawfully be excluded.
9. Suspension and termination
We may suspend or revoke access for a venue or an individual code where these Terms are breached, where we reasonably believe access is being misused, or where a commercial agreement covering that venue's use ends. A venue may stop using The Mise at any time; its own recipes and records remain its own and can be exported on request.
10. Changes to these terms
We may update these Terms from time to time. Material changes will be flagged to venues directly, with a reasonable period of notice before they take effect.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia, and the courts of that state have non-exclusive jurisdiction over any dispute. Before anything else, we'd rather sort a problem out directly — contact us first using the details below.
